    Second Amendment Background Principles and Heller\u27s Sensitive Places

    Judges and commentators have widely acknowledge that history enjoys a privileged status in Second Amendment cases, but its precise role is undertheorized and rarely controls case outcomes. In particular, courts have been unable to decide sensitive places cases-- challenges to location-based gun laws-- in a manner that adheres to Supreme Court precedent because existing Second Amendment doctrine lacks a test for sensitive places cases that uses history and tradition in a principled way. This Article proposes a solution to address that problem. An untapped source of guidance is the Court\u27s takings jurisprudence. Interpreting their respective constitutional provisions, Justice Scalia observed that both property rights and the right to keep and bear arms are fundamental rights that prefigure ratification. Specifically, Scalia observed, both the Second Amendment and the Takings Clause rely upon bright-line rules subject to a location-based exception, require the use of history and tradition in the respective analyses, and deal with property interests. In several important cases-- including Heller and McDonald-- the Court has indicated that the right to keep and bear arms is animated by property-like principles. This suggests the Court\u27s well-established takings jurisprudence is a more germane source to inform its less-developed sensitive places doctrine than the sources scholars and judges currently look to, such as free speech doctrine. This Article explores what the Court\u27s takings jurisprudence can teach us about the constitutionality of location-based gun laws. I propose a framework for courts to analyze sensitive places cases by borrowing from doctrine that is more familiar to courts, but similarly governs a pre-constitutional individual right. My examination of the Court\u27s takings doctrine indicates that the role of history and tradition in analyzing a fundamental right, like the right to keep and bear arms, is more elastic than many assume-- but that history and tradition should play a larger role than it currently does

    The Mars 94/96 Mission will carry, among others things, the balloon probe experiment. The balloon with the scientific cargo in the gondola underneath will drift in the Mars atmosphere, its altitude will range from zero, in the night, up to 5 km at noon. The accurate gondola altitude will be determined by an altimeter. As the Balloon gondola mass is strictly limited, the altimeter total mass and power consumption are critical; maximum allowed is a few hundred grams a few tens of mWatts of average power consumption. We did propose, design, and construct the laser altimeter based on the single photon ranging technique.     The determining vector of the transformation of the company capital management system is the search and integration of the latest business management tools that are oriented at achieving the planned results, and have the potential for increased efficiency and effectiveness of management actions in relation to capital and the enterprise’s activity as a whole. In view of this, the research and improvement of the conceptual provisions for performance assessment of company capital management becomes relevant. The purpose of the article is to improve the theoretical basis of performance assessment of company capital management from the point of essence’s clarification of the main concepts, principles and technology of the process. On the basis of generalization and critical analysis of theoretical knowledge of company capital management and the effectiveness of this process, there is an author definition of following concepts of “company capital”, “company capital management system”, “process of company capital management”, “the effectiveness of company capital management” in the article. There are revealed the principles, the observance of which ensure the adequacy of the object, criteria, procedures and tools for performance assessment of the company capital management in certain requirements of the subjects of assessment. It is proposed the referent model of performance assessment of company the capital management for practical use and it was determined the prospects of further scientific researches.На основании обобщения и критического анализа вопросов теории управления капиталом предпринимательских структур и результативности этого процесса обоснованы концептуальные положения оценки результативности управления капиталом предприятия. Изложена авторская точка зрения относительно трактовки капитала предприятия, системы и процесса управления им, сути и содержания понятия «результативность управления капиталом предприятия», моделирования процесса оценки результативности управленческих действий. Определены принципы, соблюдение которых обеспечивает повышение объективности результатов оценки управления капиталом и их практическую значимость для своевременной корректировки управленческих действий.На підставі узагальнення і критичного аналізу теоретичних знань з управління капіталом підприємницьких структур і результативності цього процесу обґрунтовано концептуальні положення оцінювання результативності управління капіталом підприємства. Наведена авторська точка зору щодо трактування капіталу підприємства, системи і процесу управління ним, суті та змістовності поняття «результативність управління капіталом підприємства», моделювання процесу оцінювання результативності управлінських дій.     AbstractObjectivesThis study was designed to investigate the relationship between hemoglobin level (Hgb) and adverse cardiovascular outcomes in women with suspected ischemia.BackgroundLow Hgb levels correlate with increased cardiovascular morbidity and mortality in patients presenting with acute myocardial infarction (MI) or congestive heart failure (CHF). However, the prognostic significance of Hgb in women with suspected ischemia is unclear.MethodsAs part of the National Heart, Lung, and Blood Institute (NHLBI)-sponsored Women's Ischemia Syndrome Evaluation (WISE), we prospectively studied 936 women referred for coronary angiography to evaluate suspected ischemia. We compared Hgb levels with cardiovascular risk factors, core lab interpreted angiograms, inflammatory markers, and adverse cardiovascular outcomes.ResultsOf women enrolled, 864 (mean age 58.4 ±11.6 years) had complete Hgb, angiogram, and follow-up (mean 3.3 ± 1.7 years) data. The mean Hgb was 12.9 g/dl (range 7.7 to 16.4 g/dl) and 184 women (21%) were anemic (Hgb <12 g/dl). Anemic women had higher creatinine and were more likely to be nonwhite and have a history of diabetes, hypertension, and CHF (p < 0.05). However, we found no difference in EF or severity of coronary artery disease. Anemic women had a higher risk of death from any cause (10.3% vs. 5.4%; p = 0.02) and total adverse outcomes (26% vs. 16%, p < 0.01). In a multivariable model, decreasing Hgb was associated with significantly higher risk of adverse outcomes (hazard ratio = 1.20, p = 0.002). Also, anemic women had shorter survival time free of adverse outcome (p < 0.001).ConclusionsOur findings extend previous reports, linking lower hemoglobin levels with higher risk for adverse cardiovascular outcomes, to women evaluated for suspected ischemia in the absence of acute MI or CHF

    Safety of Coronary Reactivity Testing in Women With No Obstructive Coronary Artery Disease Results From the NHLBI-Sponsored WISE (Women's Ischemia Syndrome Evaluation) Study

    ObjectivesThis study evaluated the safety of coronary reactivity testing (CRT) in symptomatic women with evidence of myocardial ischemia and no obstructive coronary artery disease (CAD).BackgroundMicrovascular coronary dysfunction (MCD) in women with no obstructive CAD portends an adverse prognosis of a 2.5% annual major adverse cardiovascular event (MACE) rate. The diagnosis of MCD is established by invasive CRT, yet the risk of CRT is unknown.MethodsThe authors evaluated 293 symptomatic women with ischemia and no obstructive CAD, who underwent CRT at 3 experienced centers. Microvascular function was assessed using a Doppler wire and injections of adenosine, acetylcholine, and nitroglycerin into the left coronary artery. CRT-related serious adverse events (SAEs), adverse events (AEs), and follow-up MACE (death, nonfatal myocardial infarction [MI], nonfatal stroke, or hospitalization for heart failure) were recorded.ResultsCRT-SAEs occurred in 2 women (0.7%) during the procedure: 1 had coronary artery dissection, and 1 developed MI associated with coronary spasm. CRT-AEs occurred in 2 women (0.7%) and included 1 transient air microembolism and 1 deep venous thrombosis. There was no CRT-related mortality. In the mean follow-up period of 5.4 years, the MACE rate was 8.2%, including 5 deaths (1.7%), 8 nonfatal MIs (2.7%), 8 nonfatal strokes (2.7%), and 11 hospitalizations for heart failure (3.8%).ConclusionsIn women undergoing CRT for suspected MCD, contemporary testing carries a relatively low risk compared with the MACE rate in these women. These results support the use of CRT by experienced operators for establishing definitive diagnosis and assessing prognosis in this at-risk population.     Measurement of χ c1 and χ c2 production with s√ = 7 TeV pp collisions at ATLAS

    The prompt and non-prompt production cross-sections for the χ c1 and χ c2 charmonium states are measured in pp collisions at s√ = 7 TeV with the ATLAS detector at the LHC using 4.5 fb−1 of integrated luminosity. The χ c states are reconstructed through the radiative decay χ c → J/ψγ (with J/ψ → μ + μ −) where photons are reconstructed from γ → e + e − conversions. The production rate of the χ c2 state relative to the χ c1 state is measured for prompt and non-prompt χ c as a function of J/ψ transverse momentum. The prompt χ c cross-sections are combined with existing measurements of prompt J/ψ production to derive the fraction of prompt J/ψ produced in feed-down from χ c decays. The fractions of χ c1 and χ c2 produced in b-hadron decays are also measured

    Single hadron response measurement and calorimeter jet energy scale uncertainty with the ATLAS detector at the LHC

    The uncertainty on the calorimeter energy response to jets of particles is derived for the ATLAS experiment at the Large Hadron Collider (LHC). First, the calorimeter response to single isolated charged hadrons is measured and compared to the Monte Carlo simulation using proton-proton collisions at centre-of-mass energies of sqrt(s) = 900 GeV and 7 TeV collected during 2009 and 2010. Then, using the decay of K_s and Lambda particles, the calorimeter response to specific types of particles (positively and negatively charged pions, protons, and anti-protons) is measured and compared to the Monte Carlo predictions. Finally, the jet energy scale uncertainty is determined by propagating the response uncertainty for single charged and neutral particles to jets. The response uncertainty is 2-5% for central isolated hadrons and 1-3% for the final calorimeter jet energy scale.Comment: 24 pages plus author list (36 pages total), 23 figures, 1 table, submitted to European Physical Journal
